“Donald Trump’s campaign lawyer promotes ‘birther’ conspiracy theory that Kamala Harris is NOT eligible to be VP because her parents were immigrants”.

The Trump campaign’s Senior Legal Advisor Jenna Ellis pushed a so-called ‘birther’ narrative Thursday that Kamala Harris isn’t eligible to be vice president because her parents weren’t citizens when she was born in Oakland, California.

‘It’s an open question, and one I think Harris should answer so the American people know for sure she is eligible,’ Ellis told ABC News.

Ellis’ views on the issue came to light after she retweeted a link to a ‘birther’ op-ed published on Newsweek’s website Wednesday written by right-wing law professor John C. Eastman.

Eastman pointed to how Article 2 of the Constitution says only a ‘natural born citizen’ can serve as vice president and president, but suggests there’s some interpretation of the 14th Amendment’s Citizenship Clause that could exclude someone in Harris’ situation.

He also argued that while the modern view of citizenship includes every person born on American soil, that belief started after Harris was born in 1964. ‘Indeed, the Supreme Court has that anyone born on U.S. soil, no matter the circumstances of the parents, is automatically a U.S. citizen,’ he also wrote.

Eastman had run as a Republican in 2010 for California attorney general, but lost his primary. Harris ultimately won the position as a Democrat.

Eastman’s op-ed received tremendous backlash, with many pointing out that it echoed the conspiracy theory pushed by President Donald Trump and others during President Barack Obama’s tenure.

Josh Chafetz, a professor at Georgetown University Law Center, called Eastman’s interpretation of eligibility as ‘racist nonsense,’ in a FactCheck.org post on the controversy.

Jenna Ellis Is absolutely correct.

To be a Natural Born Citizen, one must be born in U.S. soil and both parents must be American citizens at the time of their birth.

Harris does not meet that qualification.

Stupid argument that never worked for Obama and won’t pass the smell test for Harris…………

They need to focus on her job history rather than some stupid theory about her eligibility to run for office…..

There’s no conspiracy here. THe facts of her birth and parentage are well known.

The legal question is, “What is a Naturally Born Citizen (NBC)?” and “Is Harris an NBC?”

This gets you into philosophy, because the political and judicial process, coupled with some 240 years of removal from the initial sentiment when the term was written, make the answer to the question legalistic, political, and philosophical.

In other words, a packed court will say Kamala is fine. The current court might say Kamala is fine. Logic, and historical analysis, and the intent of the Founders will likely say she is not.

Which approach is the “right” one here?

My take: She is not according to original intent. She is not philosophically in terms of making sure that unlike Obama, “She’s from around here” and working for the home team.

But, looking at it tacticly, I think she’ll get away with it. All that will matter is birthright citizenship going forward.

And therein lies the problem. The Constitution dictates
the terms. A government or party that ignores them is
out of control, and there is no Constitution.

A condition our founders warned us about…repeatedly.

And Harris will say, “Of course I’m a natural-born citizen. The 14th Amendment says so.”

Then what? Without a definitive decision by the courts then it’s just the same kind of birther claims that was tried against Obama. How’d that work out?

Article 1; Section 2 of the United States Constitution is clear:

No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States.

She was born a citizen of Jamaica, not of the United States. But of course, the constitution doesn’t mean anything anymore. The courts tear it to shreds and ignore its precepts. The media won’t report the truth. So in the end, it’s a fight we cannot win.

Ex-Plateau PDP Chairman, three others docked over alleged conspiracy, theft - Daily Post Nigeria


A former Chairman of the Plateau chapter of the Peoples Democratic Party (PDP), Mr Yakubu Chocho, and 3 three others were on Thursday docked before Kasuwa Nama Upper Area Court I, Jos, over alleged criminal conspiracy, mischief and theft.

The three other accused persons are a cleaner, Mrs Helen Yakubu, a Guard, Mr Samka Gyol and a Carpenter, Mr Adamu Garba, all of whom pleaded not guilty to the one-count charge labelled against them by the police.

News Agency of Nigeria (NAN) reports that Helen and Samka work in the State PDP office located on No 20/22, Yakubu Gowon Way, Jos, where items, including Laptop, Golden pen and tea condiments belonging the to Partys Director of Admin, Mr Ishaku Chuntai, were stolen.

Mr Daniel Longwal, the Police prosecutor, told Malam Lawal Suleiman, the Upper Area Court presiding Judge, that on Aug. 11, the four accused persons conspired and broke into the office of the Director of Admin and stole his Laptop, Gold pen and tea condiments all amounting to N135,000.

Longwal also alleged that Chocho gave the order for the changing of the lock of the office of the Director of Admin of the party which resulted in the theft.

My Lord, the accused persons, criminally conspired to cause mischief and theft of a Laptop of N125,000, gold pen of N6,000, and Tea condiments of N2,500, an offence contrary to and punishable under sections 53, 273 and 231 of the Penal Code of Plateau State.

They conspired and broke into the office of the Director of Admin, Mr Ishaku Chuntai within the PDP office on Aug. 11, he alleged.

The Prosecutor quickly applied for an adjournment since the accused persons had not pleaded guilty to the charge.

But the defence counsel, Mr Panshak Dakyen, said even though he was against the application for an adjournment, he had an application for bail for the four accused persons.

The Judge, however, granted bail to the accused persons in the sum of N50,000 each and a surety each in like sum.

The case has been adjourned to Sept. 30 for definite hearing.

Coronavirus conspiracy theorists are planning a stand for Victoria freedom march to be held in major cities across Australia on Saturday.

Posts in a Facebook group with a following of nearly 33,000 people reveal plans to gather en-masse at local Anzac memorial sites at noon across Australia’s capital cities, except Melbourne which is subject to stage four coronavirus restrictions.

One member of the group posted a 15-minute video this week on social media calling on followers to “get together for every single Victorian”.

In the video, viewed more than 81,000 times, the conspiracy theorist also calls on Australians to stand outside their homes and “burn your mask, breathe and declare your national sovereignty”.

It comes a week after two men planning a protest where hundreds of people were set to “fill up the streets” and defy Melbourne’s lockdown last weekend were arrested and charged with incitement.

Police seized mobile phones and a computer while executing the search warrants.

A 41-year-old man from Mooroolbark and a 41-year-old Chirnside Park man will front court early next year.

Current advice from the Australian Department of Health prohibits large public gatherings and social occasions due to the risk of COVID-19.

Melbourne police have previously warned of a “dangerous” rise in people resisting lockdown measures and called for an end to the “sovereign citizen” movement.

Earlier this month Victoria’s Chief Commissioner Shane Patton said Victoria Police had seen an “emergence” of “concerning groups of people who classify themselves as ‘sovereign citizens’”.

“On at least four occasions in the last week we’ve had to smash the windows of cars and pull people out to provide details,” he said.

Police have been contacted for comment.
